1. Acceptance
By creating an account or using the Yapr app or website (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use Yapr
You must be at least 18 years old and able to form a binding contract. (Yapr processes biometric voice data; the 18+ requirement applies everywhere Yapr is offered.) If you use Yapr on behalf of an organization, you represent that you're authorized to bind it.
3. What Yapr does
Yapr provides real-time speech translation and can synthesize the translation in a voice clone you create. Features include Live conversation, two-phone Rooms translation, Learning practice (including a Roleplay practice mode where you converse with an AI character), and an Emergency phrase mode. Features, languages, and limits may change over time.
4. Voice cloning — your responsibilities (important)
- You may only create a voice clone of your own voice, with your consent. As part of enrollment you must record a consent statement; we verify it before creating a clone.
- You must not create or attempt to create a clone of anyone else's voice, or upload audio of a third party, without that person's verifiable consent and the legal right to do so. Doing so is a serious violation of these Terms and may violate law.
- You are responsible for how you use audio Yapr generates in your voice. You must not use it to deceive, impersonate, defraud, harass, or violate anyone's rights.
- We may suspend or terminate accounts that violate this section and may remove offending clones.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or infringing purposes.
- Impersonate others or misrepresent the source of generated audio, or present Yapr's AI-generated audio as authentic human speech.
- Clone or imitate any voice other than your own. Do not create, or attempt to create, a voice clone from anyone else's voice, or upload a third party's audio, without that person's verifiable consent and the legal right to do so.
- Remove, obscure, or circumvent the AI-generated markings or disclosures that Yapr applies to synthesized audio. Depending on where you are, you may also have your own legal duty to disclose AI-generated content when you share it (e.g., under the EU AI Act) — complying with local law is your responsibility.
- Reverse-engineer, scrape, overload, or circumvent security or rate limits.
- Resell or provide the Service to third parties except as expressly permitted.
- Use the Service to generate hateful, harassing, or illegal content.
6. Translation accuracy — no guarantee
Machine translation and speech recognition are imperfect. Yapr may mis-hear, mistranslate, omit, or add meaning. Do not rely on Yapr for decisions where an error could cause harm — including medical, legal, financial, safety, or immigration matters — without independent verification by a qualified human interpreter. The Service is provided as an aid, not a certified interpretation service.
7. Emergency mode — not a substitute for emergency services
Yapr's Emergency features (cached phrases, quick-dial, flashlight, SOS) are convenience aids only and may fail or be unavailable (no signal, dead battery, device limits, mistranslation). Yapr is not an emergency response service and is not a substitute for calling local emergency services or professional help. Do not rely on it as your sole means of obtaining help in an emergency. Quick-dial simply initiates a call you confirm; we are not responsible for connection, routing, or response.
8. Accounts & security
You're responsible for your account and for keeping your credentials secure. You can enable two-factor authentication (2FA) in Settings. Notify us at security@yap-r.com of any unauthorized use. You can sign out of all devices from Settings.
9. Subscriptions, billing & trials
Yapr offers a free tier and paid plans: a Trip Pass (a one-time, non-renewing pass for a set period) and Yapr Voice, an auto-renewing subscription offered monthly and annually. Current prices, any free trial, and what each plan includes are always shown in the app store before you buy and may change over time. - Billing is handled by the Apple App Store or Google Play under your store account; we never see or store your card details. Prices are shown in the store before you buy and may vary by country (taxes included where the store requires).
- Auto-renewal: subscriptions renew automatically until you cancel. Cancel anytime in your store's subscription settings; cancellation takes effect at the end of the current period.
- Refunds are governed by the applicable store's refund policy. Nothing here limits any statutory refund or guarantee rights you have as a consumer.
- EU/UK 14-day withdrawal: where you have a statutory 14-day right of withdrawal for digital services, we (or the store) will ask for your express consent to immediate performance and acknowledgment that you lose the withdrawal right once the service is fully performed / that a proportionate deduction applies. [Counsel: confirm the store flow covers this; Apple/Google handle much of it, but our checkout copy must not contradict it.]
- Price changes apply from the next renewal, with advance notice per store rules (and consent where local law requires it).
- Trials/intro offers [if offered] convert to a paid subscription unless cancelled before the trial ends; terms shown at signup.
10. Intellectual property
The Service, software, branding (including the Fennec mascot), and content are owned by Yapr or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for personal, lawful use. You retain rights in your own voice and your recordings; you grant us only the limited license needed to operate the Service for you (create your clone, synthesize speech you request) per the Privacy Policy.
11. Third-party services
The Service relies on third parties (e.g., voice, speech, translation, and infrastructure providers, and your sign-in provider). Their terms and availability may affect the Service. We're not responsible for third-party services. The current list is in our sub-processor register.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING ACCURACY, RELIABILITY, OR AVAILABILITY. If you are a consumer in the EU/UK (or another jurisdiction with mandatory consumer guarantees), nothing in this section limits the statutory rights and remedies you cannot waive — including the EU digital-content conformity guarantees. 13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAPR AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING ANY RELIANCE ON A TRANSLATION OR ON EMERGENCY FEATURES. OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS. This section does not exclude or limit liability that cannot be excluded by law (e.g., for intent/gross negligence, death or personal injury where non-excludable, or mandatory consumer rights in the EU/UK and elsewhere). 14. Indemnification
You agree to indemnify Yapr against claims arising from your misuse of the Service or violation of these Terms (including unauthorized voice cloning). [Lawyer to scope.]
15. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the Service or others. On termination we delete or de-identify your data per the Privacy Policy.
16. Changes to the Terms
We may update these Terms; we'll post the new effective date and, for material changes, notify you in-app or by email. Continued use after changes means you accept them.
17. Governing law & disputes
These Terms are governed by the laws of [STATE / COUNTRY], excluding conflict-of-laws rules. [Lawyer to decide venue, and whether to include arbitration/class-action-waiver — these are heavily regulated and vary by jurisdiction and by Apple/Google store requirements.] If you are a consumer, you keep the protection of the mandatory laws of, and access to the courts of, your country of residence. EU/UK consumers may also use the applicable ODR/ADR routes [counsel: confirm what applies post-EU-ODR-platform sunset].
18. Geographic availability, export & sanctions
- Yapr is offered in the countries where it appears in the app stores; the list can change. We may restrict or gate features by region where required by law (for example, biometric registration requirements or AI-disclosure rules).
- Yapr is not offered in jurisdictions we have excluded for legal or sanctions reasons (including mainland China and Russia at launch), and may not be used where prohibited.
- You may not use the Service if you are subject to comprehensive sanctions (e.g., on a US OFAC list or located in a comprehensively sanctioned region), and you may not use the Service in violation of export-control law.
